Probate of Decedent’s Estates, Guardianships and Conservatorships

Our firm is experienced in working in probate courts throughout Kansas in assisting clients with these matters when needs arise.

When someone dies, depending upon the existence or not of a will, the size and makeup of the estate and the relationship of the heirs or legatees with the estate, there can be different remedies available that may minimize the need for probate, or may dictate that precautions are taken to protect the fiduciary.  We work with clients to make the best decisions for proceeding and protecting the assets of the estate during probate.  We never charge based upon the size of the estate; our charges for estate services are based upon the amount of time expended.  Such fees are usually subject to the probate court approval.

Occasionally, an individual is in need of the protection of the probate court through a guardianship or conservatorship.  Sometimes the burden of these can be lessened by agreement and sometimes it is contested whether such an estate is necessary.  Oftentimes, older adults with assets will consider establish a “Living Trust” and appoint someone else as trustee to manage his or her finances.  Our firm has experience in helping clients in all sorts of different circumstances.
